Demystifying Confidentiality Laws and Substance Use Disorder Treatment

Module Materials

What is 42 CFR Part 2 and why is data sharing important for integrated behavioral health?

42 CFR Part 2 is a federal regulation that restricts the disclosure and use of patient records maintained in connection with the performance of any federally-assisted substance use disorder treatment program. In 2024, the federal government revised their rules to allow for the sharing of protected health information. By allowing for the sharing of information, healthcare providers can identify how physical health issues might be impacting mental health and substance use disorders, leading to more targeted treatment strategies. This module will review the key components of the Health Insurance Portability and Accountability Act (HIPAA) and 42 CFR Part 2, and how to effectively implement in your practice.
